BITE STUDIO operates this store and website, including all related information, content, features, tools, products, and services, to provide you, the customer, with a personalized shopping experience (the "Services"). BITE STUDIO is powered by Shopify, which enables us to provide the Services to you.

The following terms and conditions, together with the policies referenced herein (these "Terms and Conditions" or "Terms"), describe your rights and obligations when you use the Services.

SECTION 1 - ACCESS AND ACCOUNT

By agreeing to these Terms of Service, you represent that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use the Services on devices you own, purchase, or control.
In order to use the Services, including accessing or browsing our online stores or purchasing products or services we offer, you may be asked to supply certain information, such as your email address and billing, payment, and delivery information. You represent and warrant that all information you provide on our stores is accurate, current, and complete, and that you have the legal right to provide such information.
You are solely responsible for maintaining the security of your account login information and for all activity under your account. You may not transfer, sell, assign, or license your account to another person.

Section 3 – ORDERS

By placing an order, you are submitting an offer to purchase. BITE STUDIO reserves the right, at its sole discretion, to accept or decline your order for any reason. Your order will not be considered accepted until confirmed by BITE STUDIO. Acceptance of your order is subject to receipt and processing of your payment. Please review your order carefully before submitting it, as BITE STUDIO may not be able to honor cancellation requests after an order has been accepted. If we cannot accept, change, or cancel an order, we will attempt to notify you via the email address, billing address, and/or phone number you provided at the time of the order.

You represent and warrant that your purchases are for your personal or household use and not for commercial resale or export.

SECTION 4 - PRICES AND BILLING

Prices, discounts, and special offers are subject to change without notice. The price charged for a product or service will be the price in effect at the time the order is placed and will be set forth in the order confirmation email you will receive. Unless expressly stated otherwise, prices quoted do not include taxes, shipping, handling, customs, or import fees.
The prices quoted in our online stores may differ from those in brick-and-mortar stores or online stores or other stores operated by third parties.

 

From time to time, we may offer promotions for the Services that may affect pricing and may have different terms and conditions than these Terms. In the event of any inconsistency between the terms of a promotion and these Terms, the terms of the promotion will prevail.

You agree to provide current, complete, and accurate purchase, payment, and account information for all purchases made at our stores. You agree to promptly update your account and other information, including your email address, credit card numbers, and expiration dates, so that we can complete your transactions and contact you as needed.

You represent and warrant that (i) the credit card information you provide is true, accurate, and complete, (ii) you are authorized to use this credit card for the purchase, (iii) the charges you incur will be honored by your credit card company, and (iv) you will pay the charges you incur at the posted prices, including shipping and service charges and all applicable taxes.

SECTION 5 - SUBJECT MATTER AND CONCLUSION OF CONTRACT

The products offered are individually manufactured for the customer using the print-on-demand process. Production and shipping are carried out by the external fulfillment service provider Gelato ASA (Dronning Eufemias gate 8, 0191 Oslo, Norway) on our behalf. The purchase contract is concluded with BITE STUDIO. By submitting the order, you submit a binding offer to conclude a purchase contract. Acceptance occurs through an order confirmation via email or, at the latest, through the shipment of the goods.

SECTION 6 - NO RIGHT OF WITHDRAWAL FOR PRINT-ON-DEMAND

There is no right of withdrawal, as these are goods individually manufactured according to customer specifications in accordance with Section 312g Paragraph 2 No. 1 of the German Civil Code (BGB). However, if the goods are faulty, damaged, or incorrectly delivered, please contact us within 14 days of receipt at info@bite-studio.de – we will arrange a replacement or refund.

SECTION 7 – SHIPPING AND DELIVERY

Production and delivery of the goods is handled by Gelato using the print-on-demand process. Delivery times are typically 5–10 business days, depending on the delivery destination. Deliveries are made to the address provided by the customer. Delays due to production or shipping issues are beyond our control, but we always strive to process orders as quickly as possible. We are not liable for shipping and delivery delays. All delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by shipping carriers, customs clearance, or events beyond our control. Once we have transferred the products to the shipping carrier, title and risk of loss pass to you.

SECTION 8 – INTELLECTUAL PROPERTY

Our Services, including but not limited to all trademarks, logos, text, artwork, images, graphics, product reviews, video and audio files, and the design, selection, and arrangement thereof, are owned by BITE STUDIO, its affiliates, or licensors and are protected by U.S. and foreign patent, copyright, and other intellectual property laws.

These Terms of Service permit you to use the Services solely for personal, non-commercial purposes. You may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, or transmit any of the material on the Services without our prior written consent. Except as expressly provided herein, nothing in these Terms of Service grants you, nor can any such grant be inferred from these Terms of Service, any license or other right to any patent, trademark, copyright, or other intellectual property of BITE STUDIO, Shopify, or any third party. Unauthorized use of the Services may violate federal and state intellectual property laws. All rights not expressly granted herein are reserved by BITE STUDIO.
BITE STUDIO's names, logos, product and service names, designs, and slogans are trademarks of BITE STUDIO or its affiliates or licensors. You may not use these trademarks without BITE STUDIO's prior written permission. The Shopify name, logo, product and service names, designs, and slogans are trademarks of Shopify. All other names, logos, product and service names, designs, and slogans on the Services are the trademarks of their respective owners.

SECTION 9 - OPTIONAL TOOLS

You may have access to customer tools offered by third parties as part of the Services, which we neither monitor nor have any control nor input into.
You acknowledge and agree that we provide access to such tools 'as is' and 'as available' without any warranties, representations, or conditions of any kind and without any endorsement. We disclaim all liability arising from or related to your use of optional third-party tools.
Your use of any optional tools offered through the Site is entirely at your own risk and discretion. You are responsible for becoming familiar with and accepting the terms and conditions under which tools are provided by the relevant third-party provider(s).
We may also, in the future, offer new features through the Services (including the release of new tools and resources). Such new features shall be considered part of the Services and subject to these Terms and Conditions.
